In the beginning of the patent it describes the product to be wax free. Later in the patent under "Background of the Invention" they describe the product to be "virtually wax free". Which one is it? Does it have wax or doesn't it?

What distinguishes an invention? Is it the materials and ingredients it consists of/how it was made? Or, on the other, is it the uses it will be put to?
Manny Schecter (about 2 years ago)
An invention must be distinguished in view of what is actually claimed. Here, the invention is claimed as a composition, not as a method of making the composition - so it is the ingredients that matters.

I think the range is really important to distinguish a specific amount.

Regarding Claim 00001 Why is this claim so narrow? Has anyone seen prior art which requires the inventor to import these specific ranges and preferred ingredients into the first claim?
Manny Schecter (over 2 years ago)
I suspect the claims are so narrow in an attempt to distinguish over the references cited in the background section of the specification - that is where you are likely to see prior art along the lines you seek.
